This project is a townhouse development, where the resource consent sought to establish the dwellings (land use) and then subdivide around them. This is a common resource consent approach under the Auckland Unitary Plan, allowing you to subdivide off smaller sites.
Neighbours contacted the Council on multiple occasions, raising their concerns about the type and scale of the development and seeking notification of the resource consent application. Planning Plus® provided detailed planning assessment to address these issues, concluding that the neighbours were not adversely affected. The Council planner agreed with our planning assessments, that concluded the resource consent applications did not require notification.
Nonetheless, the Council planner recommend that the resource consent applications be declined. Being provided with a copy of the Council planners assessment, we undertook a comprehensive review of this, the reasoning for the recommendation and identified a number of areas where we had professional disagreement, the recommendation did not follow best planning practise, relevant case law or in our opinion was incorrect.
Planning Plus™ provided detailed planning assessment, focusing on the issues the Council planner had raised, relevant case law, highlighting correct planning practise and reasoning for our conclusion that the resource consent applications should be granted. This was considered by an independent commissioner and both the land use and subdivision consents were granted without further questioning. A great outcome for our client, and one where assessment from an experienced planner was clearly required.
